THE FAMILY of a teenager who drowned at a water park plan to sue the company in charge despite a coroner ruling it was a tragic accident.

Kajil Devi, of South Road, Feltham, drowned at Cotswold Water Park in Gloucester, while on holiday with her family, on July 11, 2010.

A coroner ruled on Tuesday that, despite criticism of the lake’s management and claims just two inexperienced lifeguards were on duty that day, the 15-year-old’s death could not have been avoided.

However, Kajil’s family this week told the Chronicle they plan to launch a private prosecution against Watermark, which runs the park.

Her 19-year-old brother Amid Kumar said: “From the witnesses we gather there were only two lifeguards, aged just 16 and 17, responsible for about 200 people in the water and on the beach. That’s not right.

“We are planning to sue because they (Watermark) need to realise their mistake and stop this happening again. No one should have to go through what we’re going through.”

Kajil’s family believe she was trying to save her younger cousin, whose dinghy had drifted into deeper water, when she slipped and went under.

The former A* Feltham Community College pupil, who could not swim, never regained consciousness after being pulled from the water.

Assistant deputy Gloucester coroner Tom Osbourne recorded a verdict of accidental death.

A spokesman for Cotswold District Council said: “This was a terrible tragedy and, as the health and safety regulating authority, we have assisted the Coroner in this inquest.

“The council will now consider the issues and evidence that emerged at the inquest. Any enforcement action could only be considered once the council’s current investigation has been completed and proper consideration given to the evidence as a whole.”

A spokesman for Watermark said: “Watermark is grateful to the coroner for his careful and thorough inquiry into this tragic accident.

“Our thoughts remain with the family of Kajil Devi at this difficult time.”
