THE fate of Grow Heathrow, the Sipson community garden run by environmental campaigners, is set to be decided once and for all.
The Grow Heathrow members will find out whether they will be evicted next week, as the landowners attempt to reclaim their land.
A two-day hearing at Central London County Court starts on Monday.
Hayes and Harlington MP John McDonnell, a staunch supporter of the project, will be a witness at the hearing.
The protracted legal battle, which started in September 2010, has been adjourned three times. At the last hearing at Uxbridge County Court in November 2011, the judge referred the case to a senior district judge, accepting that the group had squatters rights, and heed should be paid to their right to respect for their home, under Article 8 of the European Convention on Human Rights (ECHR).
They want to purchase the plot through a Community Land Trust (CTL), and keep it in the hands of local people.
The derelict site, in Vineries Close, was taken over in March 2010 by Transition Heathrow, a group of activists fighting proposals for a third runway.
With the help of villagers, they cleared 30 tonnes of rubbish from the land and set up the community market garden, but the landowner, Imran Malik, served them with an eviction notice soon after.
